The One Big Beautiful Bill Act, signed by President Trump on July 4, 2025, eliminated the $200 federal tax stamp for suppressors, short-barreled rifles (SBRs), short-barreled shotguns (SBSs), and Any Other Weapons (AOWs). What used to be called the “suppressor tax stamp process” is now more accurately described as the suppressor Form 4 process — the ATF application and background check requirements remain fully in place, but the $200 fee is gone. What is ATF Form 4?

ATF Form 4 — officially titled “Application to Transfer and Register NFA Firearm (Tax-Paid)” and identified by OMB No. 1140-0014 and ATF Form number 5320.4 — is the federal application required to transfer any NFA-regulated firearm from a licensed dealer to an individual buyer, gun trust, corporation, or other legal entity. Every legal suppressor transfer in the United States requires an approved Form 4. What the January 2026 Form 4 Revision Changed

  • Item 1 now has two checkboxes: $0 and $200 — check $0 for suppressors, SBRs, SBSs, and AOWs. Check $200 for machine guns and destructive devices

  • Race and ethnicity fields combined into a single field for simplified data entry
  • Additional electronic and digital signature types accepted — expanded eForms compatibility
  • Fillable PDF Copy 1 and Copy 2 now linked — filling in Copy 1 automatically populates Copy 2 (except checkboxes and signatures)

The regulatory framework — background check, fingerprinting, ATF approval, dealer transfer — remains completely unchanged. Only the tax payment step is gone for the eligible NFA items.

What You Need Before Starting Form 4

Before your Class 3 dealer initiates the Form 4 process, gather these items:

1. Valid government-issued photo ID. Driver’s license or state ID card is standard. Passport works. Must show your current legal residential address.

2. Fingerprint cards or digital fingerprints. Two FD-258 fingerprint cards for paper submissions, or digital fingerprints for eForms submissions. Most FFL dealers, local law enforcement offices, and dedicated fingerprint services provide this. Cost typically $20-$50.

3. Passport-style photo OR photo ID copy. As of the January 2026 revision, you may attach either a 2×2 passport-style photo taken within the last 12 months, or a copy of your government-issued photo identification.

4. Trust documentation (if using a gun trust). If you are using a gun trust for ownership, you need a copy of the trust document, the trust’s Employer Identification Number (EIN) if applicable, and Form 5320.23 (Responsible Person Questionnaire) for every trustee. Each trustee submits fingerprints and photo separately.

5. Purchased suppressor and dealer information. The suppressor must be physically at your Class 3 dealer’s premises before the Form 4 can be filed. Your dealer completes their portion of the form (Items 3a-3e, 7-8) with their FFL and SOT information.

The Form 4 Application — Section by Section

Item 1 — Transfer Type ($0 or $200). For suppressor transfers, check the $0 box. This is new for January 2026 — every suppressor Form 4 filed in 2026 or later will have this box checked.

Item 2 — Transferee Information. Your full legal name, address, and legal entity type. Check “Individual” for personal ownership, “Trust” for gun trust ownership, “Corporation” for corporate ownership, or “Other legal entity” for LLC or partnership ownership.

Items 3a-3e — Transferor Information. Your Class 3 dealer completes these fields. Ferrari Firearms fills in our FFL and business information — you do not need to know or provide this data.

Item 4 — Firearm Description. The manufacturer name, firearm type (Silencer), caliber, model, barrel length (typically N/A for suppressors), overall length, and serial number of the specific suppressor being transferred. Your dealer verifies these details against the physical suppressor.

Item 5 — Transferee FFL (if applicable). Only completed if you personally hold an FFL. Most individual buyers leave blank.

Item 6 — Transferee Special Occupational Tax status (if applicable). Only completed if you hold Class 3 SOT status. Most individual buyers leave blank.

Items 7-8 — Transferor FFL and SOT Information. Ferrari Firearms fills these in with our FFL number and Class 3 SOT information.

Items 9-11 — Signatures and Date. Your Class 3 dealer signs Item 9 as the transferor. You sign as the transferee on the transferee signature line. Date the application.

Chief Law Enforcement Officer (CLEO) Notification

Since ATF Rule 41F took effect in 2016, all Form 4 applications require CLEO notification — you must send a copy of your completed Form 4 to your local Chief Law Enforcement Officer (typically your county sheriff or police chief). CLEO notification is informational only — the CLEO does not approve or disapprove your application. It simply provides notice to local law enforcement that you are applying for the NFA firearm.

For trust and legal entity applications, every “Responsible Person” listed on the trust must complete Form 5320.23 (Responsible Person Questionnaire), and CLEO notification is required for each responsible person as well.

The Complete Form 4 Process — Step by Step

Step 2: Pay for the suppressor. Pay Ferrari Firearms for the suppressor. The suppressor is shipped from the manufacturer or distributor to Ferrari Firearms and held in secure NFA storage until your Form 4 is approved. You will not take possession of the suppressor until ATF approval comes through.

Step 3: Complete the Form 4. Ferrari Firearms initiates the Form 4 in the ATF eForms system. You complete the transferee sections electronically. Provide your fingerprints (typically at Ferrari Firearms or a local fingerprint service), attach your photo or photo ID copy, and sign electronically.

Step 4: CLEO notification. Send a copy of the completed Form 4 to your local Chief Law Enforcement Officer. This is a notification, not an approval — the CLEO does not have veto power over your application.

Step 5: Submit to ATF. The completed Form 4 is submitted through eForms. You will receive an email confirmation of submission and a tracking control number. As of January 1, 2026, no tax payment is required for suppressor Form 4 submissions.

Step 6: ATF review and background check. The ATF conducts a federal background investigation reviewing your criminal history, mental health adjudications, and other prohibited person categories. Current processing time via eForms averages 60-120 days for most applications.

After Approval — What You Need to Know

Keep your approved Form 4 with your suppressor at all times. Federal law requires you to have proof of registration in your possession when transporting or using the suppressor. Store the original in a safe place and carry a copy (photograph on your phone is acceptable) whenever transporting the suppressor.

Interstate transportation. As of 2026, you may transport your suppressor across state lines to any suppressor-legal state without additional ATF notification.
